The Legal Board of Appeal in Decision No. J10/93 (William Tuzanai) confirmed that recordal of a transfer of a European Patent Application was available after the Application was deemed withdrawn, if it was requested together with an Application for restitutio in integrum. This was to allow for circumstances in which a third party had taken possession of the Application and, subsequently realising the withdrawal of the Application, wished to restore the Application. In principle, the Legal Board of Appeal held that recordal of transfer of an Application was available with respect to any Application in which a legal remedy for the withdrawal of the Application was still available.
